1. These general conditions of sale will govern all commercial transactions between the parties, unless otherwise agreed in writing. Placing an order implies that the customer irrevocably accepts these conditions and that he expressly waives the right to enforce his own conditions of purchase and sale.

2. The sales contract will invariably be considered to have been concluded at the seller's registered office. Orders accepted by our representative only become binding after they have been confirmed by us in writing.

3. Goods will always be considered to have been sold, delivered and accepted in our warehouses. As a result, all transport risks will invariably be borne by the buyer.

4. Our delivery times are given as an indication only. Delays in delivery do not entitle the buyer to withdraw from the contract at our expense or to seek compensation. Force majeure will release the seller from his obligation to perform the contract.

5. Orders placed by the customer and accepted by us will be collected within the pre-agreed period. Failure to charge gives us the right, without any prior notice, to rescind the purchase at the fault of the buyer, who, in this case, will be liable for fixed damages of 20% of the cost price of the goods or, on the other hand, of oblige the buyer to accept delivery. Any claims regarding non-compliance of deliveries and invoices must be submitted within eight days of delivery – invoice dispatch. Claims regarding quantities must be made at the time of delivery-acceptance. Any claims made beyond the aforementioned deadlines will be considered to have been made late. In the event of justified claims, we will be obliged to replace non-conforming goods, while not compensating the buyer in any other way. Processing the goods implies that the buyer will be deemed to have accepted the goods.

6. Goods must be paid for upon presentation of our invoice. Invoices that are not paid upon presentation will automatically and without formal notice incur late payment interest at the rate of 1% per month.

7. In the event that the buyer fails to perform the contract in any other way, including non-payment (non-payment or late payment), the customer will be automatically and without formal notice liable for fixed damages at the rate of 15% of the principal, including VAT, with a minimum of 15 euros.

8. It is expressly agreed that the seller will retain full title to the goods delivered until the goods have been paid for in full. In the event of non-compliance, we reserve the right to cancel the sale and collect the goods, even if they have already been sent to third parties, at the expense of the buyer, in which case the latter will be liable for damages of 20% of the price.

9.Portuguese law applies. Any disputes will be resolved exclusively by the courts of the district where the registered office is located, which have exclusive jurisdiction. This clause forms an intrinsic part of these terms and conditions of sale and supersedes any conflicting jurisdiction clauses.

SELLING PRICE OF PRODUCTS

The sale price to the public (pvp) of the products is determined by Guerreiro & Félix and can be freely changed at any time; The pvp of the products indicated on www.guerreirofelix.pt includes VAT at the applicable legal rate and the pvp indicated is added, when due, to the delivery costs of the Product.

The pvps of the products are those shown, unless there has been an error in their indication detected by Guerreiro & Félix until they are delivered to the customer. In this case, the customer is immediately contacted via email sent to the email address provided by him. The customer can choose to keep his order at the correct price or cancel it.

PAYMENT

Guerreiro & Félix provides the customer with the following means of payment: credit card (Visa, Mastercard), PayPal, MB WAY, bank transfer and ATM reference. This last payment method is only available for payment transactions carried out in Portugal. We do not accept any other payment method than those mentioned.

In payments using credit card, all details (such as card number, expiration date or security code) will be sent by the encrypted protocol to the company that provides the electronic payment services, without third parties being able to have access. to the information transmitted. DELIVERY OF ORDERS

The delivery options for orders and the respective delivery times will be made available during the product purchase process and before the respective payment is made. If delivery is made at Guerreiro & Félix, no additional fee will be added to the price of the product.

Although we keep our catalog up to date in stock, certain products are obtained directly from the manufacturer which may delay your order. In the event that it is not possible to deliver the products ordered due to a fact attributable to the customer, a refund of the value of the product(s) will be made, except for delivery costs, when applicable. SENDING TIME

EXCHANGES AND RETURNS

We accept returns for damaged or incorrectly shipped products. See our policy regarding damaged or incorrectly shipped products.

If your order is returned due to customs problems, wrong address or absence on the day of delivery, as soon as the order arrives at our warehouse, the amount paid, deducted from the shipping cost, will be in your current account and can be deducted from a next purchase. . DAMAGED OR INCORRECTLY SHIPPED PRODUCT

That's why we ask and consider it very important that the customer checks the outer packaging at the time of delivery. Any non-compliance with your order must be reported to our customer service within 48 hours after receiving the order, otherwise it will not be accepted. You can do this through our customer support center. The complaint will be analyzed by our quality department within 72 hours.

If this is in accordance with our returns policy, we will refund the amount paid. After confirming any claim, the corresponding amount will be refunded through the same method used in the purchase, or, by another method, if there is an agreement between our services and the customer, in order to obtain a faster resolution of the process. CANCELLATIONS

The order of a product can be canceled in one of the following situations:
